Tsurumi (America), Inc. (TAI) [Tsurumi Pump] is committed to transparency about how we collect, use, disclose, and protect personal information. TAI collects personal information as described in this policy, including when you provide it directly and when it is collected automatically from your device. TAI may modify this Privacy Policy from time to time. If we make material changes, we will notify you by posting an updated version on our website with a new effective date and, when required by law, additional notice.

Use of Personal Information

You can control certain data collection activities as described in the “Cookies & Tracking,” “Your Privacy Rights,” and “Do Not Sell or Share” sections. If you submit personal information, it will be used in the following ways:

  • Internal recordkeeping and account administration
  • To operate, maintain, and improve our websites, products, and services
  • To communicate with you, including about orders, service, and marketing (where permitted by law and your preferences)
  • We do not sell personal information for money. We may “share” personal information for cross-context behavioral advertising (targeted advertising) as defined under California law. You can opt out at any time using the icon for Your Privacy Choices in the site footer.

TAI is committed to ensuring your information is secure. We employ administrative, technical, and physical safeguards designed to protect personal information. However, no method of transmission or storage is 100% secure.

Non-Personally Identifiable Information and Cookies

In some cases, we may collect information about you that is not personally identifiable, such as device identifiers, browser type, operating system, referring URLs, and general location.

When you view one of our websites, we may store information in the form of cookies and similar technologies (e.g., pixels, tags, SDKs, local storage) on your device. These technologies allow us to tailor a website or advertisement to better match your interests and preferences. Third Party Services

Payments

We may provide paid products and/or services and use third-party payment processors. We do not store or collect your payment card details. That information is provided directly to our payment processors whose use of personal information is governed by their privacy policies and applicable PCI-DSS standards. Marketing Communications

TAI uses email addresses to send our customers special promotions and product information. If you do not wish to receive these email announcements, you can unsubscribe using the link in our emails or contact [email protected].

We use HubSpot as our marketing platform. By subscribing, you acknowledge that your information will be transferred to HubSpot for processing. California Shine the Light Inquiry

If you live in California and have an established business relationship with us, you can request a list of the personal information we have shared with third parties for their direct marketing purposes. You can make a request one time each year via our data privacy request form or write to us at the address below. Mention in your letter that you are making a California Shine the Light inquiry. We will respond within 45 days (or as otherwise required by law).

California Consumer Privacy Act (CCPA)

Scope and Definitions

This section applies to California residents and uses terms as defined by the California Consumer Privacy Act (CCPA), as amended by the California Privacy Rights Act (CPRA). “Sell,” “share,” “personal information,” “sensitive personal information,” and “cross-context behavioral advertising” have the meanings given by law.

TAI collects information that can be identified, associated with, or reasonably linked, directly or indirectly, to a particular user or device. The categories we collect depend on how you interact with us. Note: Examples reference CCPA categories and are illustrative.

Sensitive Personal Information (SPI)

We do not intentionally collect SPI (e.g., SSN, driver’s license, precise geolocation) from consumers on our ecommerce sites. If SPI is provided for specific purposes (e.g., payment fraud prevention), we use it only as reasonably necessary to provide requested services, for security, and to comply with law. We do not use or disclose SPI for purposes beyond what is reasonably necessary to provide the requested services, maintain security, or comply with law; therefore, the right to limit does not apply.

Personal Information Not Covered

  • Information that is publicly available from government records
  • Aggregated or de-identified consumer information
  • Information specifically excluded from the CCPA's scope, such as:
    • Health or medical information covered by the Health Insurance Portability and Accountability Act of 1996 (HIPAA) and the California Confidentiality of Medical Information Act (CMIA) or clinical trial data
    • Personal information covered by certain sector-specific privacy laws, including the Fair Credit Reporting Act (FRCA), the Gramm-Leach-Bliley Act (GLBA) or California Financial Information Privacy Act (FIPA), and the Driver's Privacy Protection Act of 1994

Purposes of Use/Disclosure (Business or Commercial)

TAI may use or disclose collected personal information:

  • To operate our services and provide you with our services.
  • Support/respond to your inquiries; monitor and improve services.
  • Fulfill transactions, process payments, and deliver products.
  • Personalize content and experiences; provide and measure advertising, including cross-context behavioral advertising (you can opt out).

We may also disclose personal information to our parent company, Tsurumi Manufacturing Co., Ltd., as described in this Privacy Policy and not for independent use.

If we materially change the purposes, we will update this Policy and, where required, obtain your consent.

Data Retention

We retain personal information only for as long as necessary to fulfill the purposes described above, including to meet legal, accounting, or reporting obligations. We determine retention based on factors such as the type of data, the nature of our relationship with you, and legal requirements.

Disclosure for Business/Commercial Purposes (last 12 months)

For business or commercial purposes, we may have disclosed the following categories to service providers and contractors (and, where applicable, affiliates and business partners):

We may share certain personal information collected in the United States with our parent company, Tsurumi Manufacturing Co., Ltd., located in Japan for purposes consistent with this Privacy Policy, including business operations, customer service, compliance, and corporate reporting. When transferring personal information internationally, we implement appropriate safeguards in accordance with applicable U.S. and Japanese privacy laws, which may include contractual protections, secure transfer mechanisms, and limiting access to authorized personnel. We do not authorize our parent company to use personal information for independent purposes outside those described in this Privacy Policy.

We do not disclose Category C (protected classifications) or Category I (employment information) for business or commercial purposes.

We require recipients to use the information only to provide services to us and to protect it appropriately.

“Sale” and “Sharing” of Personal Information (CPRA)

We do not “sell” personal information for monetary consideration. We may “share” personal information with third parties for cross-context behavioral advertising (targeted advertising). Categories potentially shared (last 12 months) include:

Minors

TAI does not knowingly collect personal information from minors under the age of 18. We do not sell or share personal information of consumers we know are under 16 years of age without affirmative authorization (opt-in), and we do not knowingly engage in targeted advertising to minors. If you believe a minor has provided information, please contact us so we can delete it.

Your Privacy Rights (including CCPA/CPRA Rights)

  • Know/access categories and specific pieces of personal information.
  • We may not be able to associate certain data (such as some cookie or device information) with you unless you provide additional information to help us verify your identity.
  • Delete personal information (subject to exceptions).
  • Correct inaccurate personal information.
  • Opt out of the sale or sharing of personal information.
  • Non-discrimination for exercising rights.
  • Request to receive certain personal information in a portable, readily usable format.

How to Submit Requests

To make a CCPA/CPRA request, complete our data privacy request form or call 1-888-878-7864 and ask to speak with the Data Privacy Team.

Only you or an authorized agent may submit a verifiable request. We will respond within 45 days (or as permitted by law), and may extend once by an additional 45 days with notice.

Verification: Provide sufficient information for us to verify your identity (or your authority as an agent). We will use information provided in a request solely to verify and respond.

International Data Transfers

We are based in the United States and may process your information in the U.S. and other countries that may not provide the same level of data protection as your home jurisdiction. Where required, we use appropriate safeguards for data transfers.
